Terms of Service
FREE PLANET VPN S.R.L. (hereafter referred to as “Company,” “we,” or “our”) is the owner and operator of the VPN service known under the trademark FREE PLANET VPN (hereafter referred to as “FREE PLANET VPN,” “the Service”).
Hereinafter, for clarity and consistency, the term “FREE PLANET VPN” may refer to either the trademark or the company operating the service.
Date of Effectiveness:
The following Terms of Service (hereinafter, the “Terms”) govern access to and use of the FREE PLANET VPN websites (freeplanetvpn.com), FREE PLANET VPN applications (hereinafter, the “Apps”), and all related services (collectively, the “Services”). By accessing or using our websites, applications, or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Where an individual accepts these Terms on behalf of an organization or employer, they hereby represent and warrant that they have full authority to bind such entities to these Terms.
These Terms, together with the Privacy Policy and any other applicable published policies, constitute a legally binding agreement between the User and FREE PLANET VPN. Should any provision herein be deemed unacceptable, users are respectfully requested not to install the Apps or utilize the Services.
1. General
The services provided by FREE PLANET VPN herein comprise a virtual private network (VPN) designed to enhance online security and privacy.
Certain features may require the creation of an account. The account holder shall be solely responsible for all actions and transactions conducted under their account, including any actions performed by third parties granted access thereto.
FREE PLANET VPN shall not engage in the logging of online activity. Account creation may necessitate the collection of minimal information, including, but not limited to, an email address and password. For paid subscriptions, payment details shall be required. Users are hereby obligated to ensure that all information provided is accurate and current.
Users shall maintain the confidentiality of their login credentials. In the event of unauthorized access or use, users shall immediately notify the appropriate authorities.
Use of the Services shall be at the sole discretion and risk of the user. FREE PLANET VPN reserves the right, at its sole discretion, to modify, suspend, or discontinue any aspect of the Services at any time, without prior notice.
2. Changes to Terms
These Terms may be amended at any time through the publication of a revised version on the website. The date of the most recent revision shall be indicated at the top of this page. By continuing to use the Services following any such amendments, the User hereby acknowledges and agrees to be bound by the revised Terms.
3. Privacy
FREE PLANET VPN does not track or log users’ browsing activity, including visited websites, DNS queries, or email communications. Logging of technical connection attempts is conducted solely for of security and troubleshooting.
The disclosure of personal data to third parties shall not occur, except as expressly provided in the institution’s [Privacy Policy]. Requests from governmental authorities shall only be honored if they are legally binding and fall within the appropriate jurisdiction.
4. Third-Party Services
It should be noted that the Apps and websites may include content, features, or links provided by third parties. FREE PLANET VPN does not exercise control over such third-party resources and shall not be held responsible for their terms, policies, or availability. Use of third-party services is undertaken at the user’s sole discretion and risk.
5. License
A limited, personal, revocable, and non-transferable license to access and use the Apps, Websites, and Services is hereby granted. All rights, title, and interest in and to the software, design, and content shall remain the sole and exclusive property of FREE PLANET VPN.
The Services are provided solely for personal use and shall not be copied, modified, reproduced, resold, leased, or otherwise interfered with in any manner. Any attempt to reverse engineer, decompile, or otherwise compromise the Services is strictly prohibited and shall be subject to enforcement to the fullest extent permitted by law.
6. Subscriptions
The Company offers the Services in both free and paid formats.
6.1 Duration and Pricing
Details regarding current subscription plans and associated pricing are available within the Apps and on the Company’s website. Any changes to pricing by FREE PLANET VPN shall be implemented following prior notification to users.
6.2 Free Trials
FREE PLANET VPN may, from time to time, provide free trials of premium features. The terms and conditions governing such free trials shall be provided herein separately. Should the free trial not be canceled prior to its expiration, the user’s designated payment method shall be charged automatically for the subsequent subscription period, at the user’s sole risk and responsibility.
6.3 Auto-Renewal
By default, subscriptions shall be subject to automatic renewal, provided that the designated payment method has been verified as active. The user may turn off automatic renewal through the account settings.
6.4 Payments and Refunds
All payments shall be processed exclusively by third-party providers. Purchases made through the Company’s website are subject to a money-back guarantee, as detailed herein:
- 14 days for 1-month plans
- 30 days for 4-year plans
Renewals shall not be eligible for a refund. For purchases made through third-party app stores (including, but not limited to, the Apple App Store or Google Play), any refunds shall be governed solely by the respective store’s policies.
7. Prohibited Uses
By using the Services, you agree not to engage in any of the following activities:
- unlawful, fraudulent, or malicious purposes;
- sending spam or distributing malware;
- infringing intellectual property rights;
- posting content involving violence, hate, or exploitation of minors;
- unauthorized system/network access (“hacking”);
- military or cyberwarfare activities;
- attempting to interfere with or bypass FREE PLANET VPN systems.
FREE PLANET VPN reserves the right to terminate any account found to violate of these Terms, without entitlement to a refund.
8. Warranty Disclaimer
The Services are provided “as is” and without any warranty of any kind, whether express or implied. Uninterrupted service, error-free operation, and compatibility with all devices are not guaranteed. Use of FREE PLANET VPN is undertaken at the user’s sole discretion and risk.
9. Liability Limitation
FREE PLANET VPN, its employees, and its business partners shall not be liable for any damages, whether direct, indirect, incidental, or consequential, including but not limited to loss of data, business interruption, or lost profits, arising from the use of the Services. The maximum aggregate liability of the foregoing parties shall be limited to the amount actually paid by the user for the Services.
10. Indemnification
By accepting these Terms, you agree to indemnify, defend, and hold FREE PLANET VPN harmless from and against any claims, damages, liabilities, or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or any misuse of the Services.
11. Arbitral proceedings
The governance of these Terms is subject to the legal framework of Romania. In the event of any disputes, the matter shall be submitted to arbitration in accordance with the rules of the Romanian Chamber of Commerce and Industry or another mutually agreed Romanian arbitration institution. The proceedings will be conducted in English, and the arbitral award shall be final and binding upon the parties.
